Seront poursuivis : - Toutes personnes diffusant les pochettes originales du site "Toto Fan Page" (http://toto.fan.free.fr/) sans autorisation. - Toutes personnes utilisant les pochettes originales du site "Toto Fan Page" (http://toto.fan.free.fr/) , à des fins de vente du Bootleg concerné ou de la pochette originale du site "Toto Fan Page" (http://toto.fan.free.fr/) . - Toutes personnes détournant, plagiant, les créations originales du site "Toto Fan Page" (http://toto.fan.free.fr/). - Toutes personnes effaçant le copyright inclus sur les pochettes et/ou dans le fichier, afin de les utiliser, reproduire, copier et diffuser à son propre compte, ou autres... - Toutes personnes qui bafouent les lois sur le copyright d'une oeuvre. Mais également le non-respect du droit à la propriété, à la propriété intellectuelle (art 122-5)... - Toutes personnes qui ne respecteraient pas le contrat Creative Commons dans son intégralité. |

La personne doit : - Demander une autorisation au webmaster du site "Toto Fan Page" (http://toto.fan.free.fr/) en le contactant par émail. - Signer la charte du site "Toto Fan Page" (http://toto.fan.free.fr/) La charte ne sera valable que si elle comporte les signatures et l'identification du demandeur et du webmaster du site "Toto Fan Page" (http://toto.fan.free.fr/)
La personne s'engage : - A indiquer clairement et en grande police, juste à côté de la pochette : Pochette originale du site "Toto Fan Page", Pochette entière : Cliquer sur le lien. Et indiquer et créer le lien direct vers le site "Toto Fan Page" : http://toto.fan.free.fr/ - D'informer Le webmaster du site "Toto Fan Page" (http://toto.fan.free.fr/), à chaque utilisation d'une pochette de sa création, en indiquant le nom, la date de la pochette diffusée. - A vérifier que le lien vers le site "Toto Fan Page" (http://toto.fan.free.fr/) est toujours actif. - D'informer Le webmaster du site "Toto Fan Page" (http://toto.fan.free.fr/), si le nom ou l'adresse de son site change. - A ne pas effacer le copyright inclus sur les pochettes et dans le fichier. - Ne pas reproduire, copier, plagier et diffuser la pochette à son propre compte. - Respecter toutes les clauses de la charte qu'il aura signée, sous peine de se voir interdire de diffusion et être poursuivi légalement. - Respecter le contrat Creative Commons dans son intégralité, sous peine de poursuites.
Le webmaster s'engage : - A faire signer la charte au demandeur. - A indiquer clairement, sur la page des liens (Links) du site, le nom du site autorisé à diffuser les pochettes originales du site "Toto Fan Page" (http://toto.fan.free.fr/) - A informer le demandeur, de toutes mises à jour, concernant les pochettes autorisées à la diffusion, sur le site du demandeur.
Le webmaster du site "Toto Fan France" autorise : - L'utilisation personnelle, dans le cadre de sa propre Cdthéque, sans aucunes autres utilisations, reproduction, copie, plagiat et diffusion. - Après accord et signature de la charte, autorise uniquement la diffusion, des pochettes originales du site "Toto Fan Page" (http://toto.fan.free.fr/), sur un site clairement et préalablement identifié. |

Penalty of legal proceedings for : - All people diffusing the original covers of the website "Toto Fan Page" (http://toto.fan.free.fr/) without authorization. - All people using the original covers of the website "Toto Fan Page" (http://toto.fan.free.fr/), for the sale of Bootleg concerned or the sale of the original cover of the site "Toto Fan Page" (http://toto.fan.free.fr/). - All people diverting, plagiarizing, original artworks of the website "Toto Fan Page" (http://toto.fan.free.fr/). - All people erasing the copyright included on the covers and/or in the file, to use them, reproduce, copy and diffuse with its own account, or others... - All people who do not respect the laws on the copyright. But also which does not respect the laws of the right to the property, with the intellectual property (art 122-5)... - All people who do not respect the contract Creative Commons |
